1.1 This agreement applies to all purchases of Wairoa Bakery 1996 Limited (trading as Viands Bakery) products and services by you from Viands Bakery website and replaces all previous agreements between you and us.
1.2 Wairoa Bakery 1996 Limited may change the terms of this agreement from time to time using the process set out in clause 12.
This is an important agreement which you must read through before purchasing products from our website. Making a purchase from our website specifies you have agreed to these terms and conditions.
2.1 In this agreement unless the context otherwise requires:
“You” or “your” means the purchaser.
“Us”, “we” or “our” means Viands Bakery
“Agreement” means this agreement and includes any other terms incorporated into it by reference.
“Information” means all the information supplied by you to us via the website or otherwise and includes, for example, your name, contact details, credit card details and your payment and transaction history.
“GST” means good and services tax.
“Products” means all products available for purchase on our website.
3. Purchase Terms
3.1 When purchasing products on the website you confirm and acknowledge that:
(a)All information supplied by you to us is true and correct at the time you make any purchase on the website.
(b) We may restrict your ability to purchase products via the website by imposing a credit limit on your account.
4.1 Prices quoted on our website are inclusive of GST. You must pay us the full price quoted on the website at the time the order is submitted. Prices are given in New Zealand dollars.
4.2 We reserve the right to vary our prices without notice. No adjustments are made if the price of a product increases or decreases between the time the order is submitted and the time the product is delivered.
5. Transit Cost
5.1 Product prices quoted do not include transit costs. Any courier or handling charges in relation to your order will be notified to you at the time you place your order and added to the price. Purchases made on our website will be delivered only within New Zealand.
6. Mistakes in Price Arising from Computer Error
6.1 In the event the computer error results in a material misstatement of the price of your order we may, prior to your receipt of the order or at any time thereafter, require that you pay us the different between the amount actually paid by you in respect of your order and the correct amount payable.
7. Product Availability
7.1 All products are sold subject to their availability. Promotional items may be limited as to quantity. We shall not be responsible for our inability to supply products to you where they are not presently available or where our stock of the relevant product(s) has been exhausted.
8. Delivery & Transit
8.1 Unless a preferred delivery time is provided, orders received by the prescribed time, will be despatched no later than two business days after the day your order is received by us, except for Mondays, Saturdays, Sundays or Public Holidays. We are not responsible for any failure to deliver or relay in delivery caused by any event outside of our reasonable control. Some remote areas of New Zealand may require up to 48 Hours for deliveries. Out-of-town or rural deliveries may not be possible.
8.2 Where we fail to deliver or delay delivery of your order or part of your order or where any loss is incurred by you in relation to such delivery and is within our control, our liability shall be restricted to payment of the cost of replacing the order or part of the order, as we may determine.
8.3 Delivery is complete when the products reach the address you have specified for delivery.
8.4 Nothing in these terms entitles you to return the products as being surplus to your needs, or for any other reason than set out therein.
8.5 We do not deliver to P O Box addresses, we deliver to your physical address and/or a business address as a signature is required.
9. Charges and Invoicing
9.1 You must pay us in full at the time that you submit your order.
9.2 If you pay by credit card you agree to indemnify us against any default by our credit card company to make payment to us in full.
10. Cancellation, Return and Replacement
10.1 Subject to clause 8 of this agreement.
(a) After we have accepted your order for the products, you may not cancel the order without our consent.
(b) For any reason you want to return the product it is returned at your own cost and the product has to be returned in fill before any refund or credit can be given.
11.1 Any information about you collected through this website is used exclusively for the purpose of processing orders, improving your shopping experience, and to communicate with you regarding products, services and promotions. We will only collect personal information to the extent deemed reasonably necessary to serve our legitimate business purposes. We will store any information that you provide securely and will not sell or release it to any other business or person.
“Viands Bakery” will not be responsible or liable for any loss or privacy, disclosure of information, damage or loss may result from your transmission of or any information you may send us in any connection with this website.
12.1 We may change the terms of this agreement by sending you notice (“amendment notice”) to that effect by your preferred contact method and supplying you with the amended agreement.
